Court Extends Pre-Trial Liberty in Alleged Sabarimala Gold Misappropriation Case

A Kerala court has granted bail to a former official of the Travancore Devaswom Board in the alleged Sabarimala gold theft case. The court held that continued custodial detention was not necessary at the present stage of the investigation.

The court found that the prosecution failed to show compelling grounds for further incarceration. It reaffirmed that bail, not jail, governs criminal proceedings when investigators can proceed without custodial interrogation.

Background of the Sabarimala Gold Theft Allegations

The case stems from allegations of misappropriation of gold ornaments and valuables belonging to the Sabarimala Temple. These assets were under the custody of the Devaswom administration.

The prosecution alleged that internal audits revealed financial irregularities. These findings raised suspicion of criminal breach of trust, misappropriation of property, and abuse of official position. Based on these allegations, the investigating agency registered a crime and arrested the former board official.

Court Holds Further Custody Unwarranted

While considering the bail plea, the court examined whether custody remained essential for effective investigation. It noted that investigators had already seized relevant documents and recorded key witness statements.

The court observed that material evidence stood secured. It ruled that prolonged detention would amount to pre-trial punishment, especially since the accused agreed to cooperate with the investigation.

The court granted bail subject to strict conditions to protect the investigation. These conditions include:

  • Mandatory cooperation with the investigating officer
  • Prohibition on influencing or contacting prosecution witnesses
  • Restriction on leaving the jurisdiction without prior permission

The court warned that any violation would entitle the prosecution to seek cancellation of bail.
