Court Intervenes to Correct Unfair Sports Selection and Protect Athlete Rights
The Delhi High Court has directed the inclusion of Indian skier Manjeet in the national contingent for the 2026 Winter Olympics, sharply criticising the selection process adopted by the Indian Olympic Association (IOA) as arbitrary, opaque, and unfair.
The Court held that the exclusion of the athlete lacked transparency and violated principles of fairness, merit, and equal opportunity, warranting immediate judicial intervention.
Dispute Over Exclusion of Skier Manjeet
The controversy arose after Manjeet, a competitive winter sports athlete, was excluded from the list of nominees for the 2026 Winter Olympics despite meeting the eligibility and performance benchmarks. Aggrieved by the decision, the athlete approached the Delhi High Court, alleging arbitrariness, non-application of mind, and absence of objective criteria in the IOA’s selection process.
Manjeet argued that the selection body failed to disclose clear parameters and disregarded relevant performance data while finalising the list.
Court Slams IOA for Arbitrary and Non-Transparent Procedure
After examining the record, the High Court found serious deficiencies in the IOA’s selection mechanism. The Court observed that the process lacked consistency, accountability, and documented reasoning.
The bench held that sporting bodies, though autonomous, cannot function in an arbitrary manner. When public interest, athlete careers, and national representation are involved, decision-making must adhere to constitutional values of fairness and reasonableness.
Judicial Emphasis on Merit, Transparency, and Fair Play
The Court reiterated that merit must remain the cornerstone of sports selection. It stressed that athletes invest years of training and resources, and their exclusion without just cause amounts to institutional unfairness.
The Court further observed that opaque selection processes discourage sporting excellence and undermine confidence in national sports governance.
Direction to Include Athlete for Winter Olympics 2026
In view of the findings, the Delhi High Court directed the IOA to include Manjeet in the list of athletes representing India at the 2026 Winter Olympics. The Court issued the direction to ensure that an eligible athlete does not lose an international opportunity due to administrative lapses or arbitrary decision-making.
The Court clarified that sporting authorities must evolve transparent, objective, and documented selection criteria to prevent future disputes.
Legal Significance of the Ruling
The ruling reinforces judicial oversight over sports administration and affirms that sports bodies are subject to constitutional scrutiny when their decisions affect fundamental rights and legitimate expectations.
