The Supreme Court has upheld the Witchcraft Murder Life Sentence awarded to Balku Oram for murdering a woman over allegations of witchcraft. The case, Balku Oram v. State of Odisha, came before a Bench of Justices Prashant Kumar Mishra and NV Anjaria.
Supreme Court Confirms Conviction
The Bench upheld the findings of the trial court and the Orissa High Court. Both courts had found Balku Oram guilty of murder.
The Supreme Court also found no reason to interfere with the conviction or sentence. The Bench relied on the direct evidence presented during the trial.
Direct Evidence Proved the Accused’s Role
The Court examined the evidence against Balku Oram and the co-accused. It found the direct evidence strong enough to establish their involvement in the killing.
Moreover, the Court noted that the evidence clearly connected the accused with the murder. Therefore, it confirmed the findings reached by the lower courts.
Woman Murdered Over Witchcraft Allegation
According to the prosecution, the accused blamed the deceased woman for the death of Manobodha Naik’s youngest daughter. They alleged that she had caused the death through witchcraft.
Following the allegation, the accused brutally killed the woman.
The Supreme Court found the evidence against Balku Oram compelling. The Court held that the evidence clearly established his role in the murder along with the co-accused.
Court Relies on Direct Evidence
The Bench placed significant reliance on the direct evidence available in the case. It found that the evidence sufficiently established the circumstances surrounding the murder.
Furthermore, the Court found that the prosecution had established the accused’s involvement beyond reasonable doubt.
The Bench therefore declined to disturb the concurrent findings of the trial court and the High Court.
Life Sentence Remains in Force
With the Supreme Court’s decision, the life sentence imposed on Balku Oram remains intact. The judgment reinforces the importance of strong direct evidence in establishing criminal liability.
