Supreme Court Voices Discomfort Over Exclusion of ‘Loss of Love and Affection’ in Motor Accident Claims

The Supreme Court has expressed reservations about the Constitution Bench ruling in National Insurance Co. Ltd. v. Pranay Sethi, which bars compensation for “loss of love and affection” as a separate head in motor accident claims.

A Bench comprising Justices Dipankar Datta and S. C. Sharma stated that although it remains bound by the Constitution Bench ruling, it finds the exclusion conceptually difficult to reconcile.

Scope of Non-Pecuniary Damages Under Pranay Sethi

In Pranay Sethi, the Constitution Bench confined non-pecuniary damages to three conventional heads:

  • Loss of estate
  • Loss of consortium
  • Funeral expenses

The Bench expressly disapproved awards under a separate head for “loss of love and affection.”

However, the present Bench questioned this exclusion. It pointed out that Pranay Sethi itself judicially evolved the concept of “future prospects” while computing compensation. Therefore, it asked why courts cannot similarly recognise emotional deprivation caused by a fatal accident.

Justice Dipankar Datta, authoring the judgment, observed that the reasoning creates a conceptual tension. If courts can acknowledge anticipated economic progression through judicial interpretation, they should logically examine emotional deprivation as well.

Moreover, the Court emphasised that Chapter XII of the Motor Vehicles Act provides a beneficial framework. The legislation aims to grant meaningful relief to accident victims and their families.

Background of the Case

The matter arose from a fatal road accident on June 9, 2011. A 37-year-old driver lost his life. His widow, children, and mother filed a claim before the Motor Accidents Claims Tribunal (MACT), Chennai.

In 2012, the MACT awarded ₹9.37 lakh. It assessed the deceased’s income at ₹6,000 per month and declined to add future prospects.

On appeal, the Madras High Court enhanced the compensation to ₹10.51 lakh. The High Court fixed the monthly income at ₹7,000. However, it again refused to add future prospects. It also awarded ₹60,000 under the head of “loss of love and affection.”

Dissatisfied, the dependents approached the Supreme Court seeking enhancement.

Supreme Court Applies Binding Precedent

The Supreme Court enhanced the overall compensation. It held that the High Court’s computation did not conform to the standards laid down in Pranay Sethi.

However, the Court set aside the amount granted for “loss of love and affection.” It did so because it remains bound by the Constitution Bench decision.

The Bench clarified that Rajesh v. Rajbir Singh, which had earlier recognised this head, stands overruled by Pranay Sethi.

Furthermore, the Court referred to:

  • Magma General Insurance Co. Ltd. v. Nanu Ram
  • United India Insurance Co. Ltd. v. Satinder Kaur

These decisions expanded the concept of consortium to include spousal, parental, and filial consortium. Therefore, emotional loss suffered by dependents falls within the recognised categories of consortium.

Compensation Enhanced to ₹20.80 Lakh

Consequently, the Court subsumed the loss arising from deprivation of love and affection under the broader head of “loss of consortium.”

On this basis, it enhanced the total compensation to ₹20.80 lakh, compared to the original award of ₹9.37 lakh.

Reiterating its position, the Bench stated that Pranay Sethi does not permit compensation for “loss of love and affection” as an independent head. As clarified in Satinder Kaur, read with Pranay Sethi and Magma General Insurance, such non-pecuniary loss stands absorbed within consortium.
