Court Dismisses Three Connected Bail Appeals
The Rajasthan HC refuses bail to three Myanmar nationals in connected criminal appeals arising from FIR No. RC/01/2023/NIA/Jaipur registered at Police Station NIA, Jaipur. The Division Bench of Justice Inderjeet Singh and Justice Bhuwan Goyal delivered the order on June 29, 2026, in Mohammad Usman v. National Investigation Agency, along with connected appeals filed by Shafi Alam alias Shofi Alam and Rabi Ul Islam. The Court upheld the Special Court’s orders rejecting their bail applications.
The appeals challenged the orders dated November 12, 2025, October 8, 2024, and November 7, 2024, passed by the Special Judge, NIA Cases, Rajasthan, Jaipur, in Bail Application Nos. 78/2025, 53/2024, and 65/2024.
Background of the Appeals
Mohammad Usman, son of Noor Hussain, filed D.B. Criminal Appeal No. 516/2025. He is 39 years old and originally belongs to Fakira Bazar, Mangdau, Arakan, Myanmar. At the time of the proceedings, he was residing near Rahat Hospital in Jammu and Kashmir.
Meanwhile, Shafi Alam alias Shofi Alam, son of Hadi Hussain, filed one of the connected appeals. He is 27 years old and belongs to Shah Bazar, Mongdau, Arakan, Myanmar. He was residing in Nagara Dubba Thanda, Veerabothnapalli, Deendee, Nalgonda, Telangana.
Similarly, Rabi Ul Islam, son of late Abdul Haque, filed the third appeal. He is 30 years old and belongs to Nagakhua, Mangdev, Myanmar. He was residing at Plot No. 7, Shahpur Nagali, Nuh, Haryana.
All three appellants remain in judicial custody at Central Jail, Jaipur.
Appellants Cited Long Custody and Trial Delay
Counsel for the appellants argued that the authorities had falsely implicated them in the case. They also informed the Court that the trial court had already recorded the statements of protected witnesses.
Further, the appellants pointed out that they had spent more than two years in judicial custody. They argued that the trial would likely take considerable time to conclude. Therefore, they requested the Court to grant them bail.
Advocates Syed Saadat Ali, Nadeem Qadeer, Uzma Ilyas, Aafreen Rizvi, Sumit Kumar Upadhayay, and Shoaib Mirza represented the appellants.
NIA Opposed the Bail Pleas
However, the National Investigation Agency strongly opposed the appeals through Special Public Prosecutor Sneh Deep Khyaliya.
According to the prosecution, the allegations against the accused are serious. The NIA alleged that the accused illegally brought Rohingya-origin girls into India without valid passports by deceiving them with promises of marriage. Afterward, they allegedly sold the victims.
Additionally, the prosecution argued that all three appellants are Myanmar nationals. If released on bail, they could threaten the victims or complainant and flee from India. The NIA also informed the Court that the statements of several material witnesses and victims had not yet been recorded.
Court Finds Allegations Serious
After hearing both sides, the Division Bench examined the case records, the statements of protected witnesses, and the gravity of the allegations.
The judges concluded that the facts did not justify granting bail. As a result, the Rajasthan HC refuses bail to all three accused and dismissed their connected criminal appeals.
Notably, the order does not refer to any statutory provisions or judicial precedents relied upon by either side.
Final Direction
Finally, the Rajasthan High Court dismissed all three criminal appeals. The Bench also directed the Registry to place a copy of the order in each connected case file.
