Order IX Rule 13 CPC Plea Maintainable Despite Appeal Dismissal: Supreme Court
The Supreme Court clarifies that dismissal of an appeal against an ex parte decree does not bar a subsequent application under Order IX Rule 13 CPC.
The Supreme Court has held that a party can move an application under Order IX Rule 13 of the Code of Civil Procedure, 1908 to set aside an ex parte decree even after dismissal of an appeal against the same decree.
The trial court had passed an ex parte decree against the defendant. The aggrieved party first challenged that decree in appeal. However, the appellate court dismissed the appeal.
The party then moved the trial court under Order IX Rule 13 CPC. It sought to set aside the ex parte decree. This led to the dispute before the Supreme Court.
The main question was whether dismissal of an appeal against an ex parte decree bars the defendant from pursuing the separate remedy under Order IX Rule 13 CPC.
The Court examined Order IX Rule 13 CPC. The provision allows a party to seek setting aside of an ex parte decree by showing sufficient cause. The Court also examined how this remedy operates alongside the appellate remedy.
The Supreme Court clarified that the two remedies are distinct and independent. A party may challenge an ex parte decree in appeal. A party may also move an application under Order IX Rule 13 CPC. Dismissal of one remedy does not automatically defeat the other.
The Court added that a bar may arise only in a limited situation. That would happen if the appellate court has already decided issues that overlap with the grounds raised in the Order IX Rule 13 application.
However, where no such overlapping adjudication has taken place, the statutory remedy under Order IX Rule 13 CPC remains available.
The Court stressed that procedural law should not unfairly curtail remedies available to litigants.
Accordingly, the Supreme Court held that an application under Order IX Rule 13 CPC is not barred merely because an appeal against the ex parte decree has been dismissed. It therefore affirmed the maintainability of such an application. The party may now pursue relief before the appropriate forum in accordance with law.
