The Nedumangad child death Kerala High Court case has prompted the High Court to initiate suo motu public interest proceedings over the death of a one-and-a-half-year-old toddler in Thiruvananthapuram. A Division Bench comprising Chief Justice Soumen Sen and Justice Syam Kumar V.M. sought a detailed status report on the investigation and directed the State to submit the progress of the probe in a sealed cover.
The Bench acted after reports alleged that the toddler died following prolonged physical abuse by his stepfather. The Court also asked the State Government to explain the steps taken during the investigation and the action initiated by child protection authorities.
Background of the Case
The proceedings arise from the death of the toddler on May 29, 2026, in Nedumangad, Thiruvananthapuram. According to the allegations, the child’s mother’s partner repeatedly assaulted the toddler, resulting in his death.
The incident sparked widespread public concern over the effectiveness of child protection mechanisms in Kerala. In response, the High Court initiated a suo motu public interest litigation to examine the quality of the investigation and the role of authorities responsible for child welfare.
Court Expresses Concern Over Alleged Inaction
During the hearing, the Bench considered allegations that the District Child Protection Officer (DCPO), Thiruvananthapuram, failed to act despite receiving prior information from the child’s grandmother about possible abuse.
Referring to the allegation, the Court orally observed:
“Specific allegation is that the District Child Protection Officer of Trivandrum had not taken steps in spite of the child’s grandmother specifically informing them in advance what is happening.”
The Bench indicated that the allegation requires serious scrutiny because child protection authorities have statutory duties to safeguard children.
Directions Issued by the Court
The Division Bench directed the Government Pleader to file an affidavit explaining the action taken by the State authorities.
The affidavit must include:
- Steps taken during the investigation into the child’s death.
- Progress achieved in the investigation.
- Current status of the probe, to be submitted in a sealed cover before the Court.
The Nedumangad child death Kerala High Court proceedings will also examine whether the authorities fulfilled their responsibilities under child protection laws.
Additional Respondents Impleaded
During the hearing, the Government Pleader submitted that the Secretary of the Social Justice Department should be included because the department oversees child welfare measures and related policies.
The Court accepted the request and impleaded the Secretary of the Social Justice Department as an additional respondent.
The Bench also issued notice to the Kerala State Legal Services Authority (KeLSA) and added it as a respondent in the suo motu proceedings.
Next Hearing
The High Court scheduled the matter for further hearing after two weeks. It will review the State’s affidavit and assess the progress of the ongoing investigation.
