Apex Court Clarifies When Limitation Begins Under Property And Limitation Laws

The Supreme Court of India has ruled that in a usufructuary mortgage, the limitation period for redemption begins from the date on which the mortgage money is paid or deposited. It does not start from the date of execution of the mortgage deed.

By doing so, the Court has clarified the correct application of limitation law to possession-based mortgages under Indian property law.

Background Of The Dispute

The dispute arose from a suit seeking redemption of a usufructuary mortgage. The key issue before the Court was the correct starting point of limitation for filing such a suit.

On one hand, the mortgagee argued that the claim was time-barred. According to them, limitation should run from the date of execution of the mortgage deed.

On the other hand, the mortgagor contended that the right of redemption arises only after repayment or tender of the mortgage amount, as recognised under the Transfer of Property Act.

Supreme Court’s Legal Analysis

After examining statutory provisions and binding precedents, the Supreme Court held that usufructuary mortgages operate on a distinct legal footing.

The Court observed that:

  • In a usufructuary mortgage, the mortgagee remains in possession
  • The mortgagee enjoys usufruct in lieu of interest or principal
  • The mortgagor can enforce the right of redemption only after paying or depositing the mortgage money

Therefore, the Court clarified that the cause of action for redemption arises only upon such payment, which then triggers the limitation period.

Importantly, the Court noted that computing limitation from the date of execution would defeat the nature of a usufructuary mortgage and unjustly extinguish valuable redemption rights.

Limitation Law And Right Of Redemption

The Bench reiterated that limitation laws regulate remedies, not substantive rights. Hence, courts must apply limitation provisions in harmony with property law principles.

In the case of usufructuary mortgages, the Court stressed that the right of redemption remains dormant until repayment. As a result, limitation cannot begin to run before that stage.

Final Ruling Of The Court

While upholding the mortgagor’s claim, the Supreme Court ruled that:

  • Limitation for redemption runs from the date of payment or tender of mortgage money
  • Courts cannot reject redemption suits merely because the mortgage deed is old
  • Judges must examine the terms of the mortgage and nature of possession before dismissing claims on limitation grounds

Accordingly, the Court protected the mortgagor’s right to redeem the property.
