Kerala High Court Wayanad Landslide Compensation Order Directs Immediate Relief
The Kerala High Court Wayanad landslide compensation order directs the State government to provide immediate financial assistance to victims of the recent Wayanad landslide. A Division Bench also ordered the government to offer free medical treatment to the injured and ensure the prompt return of the deceased to their families. The Court issued these directions while taking suo motu note of the tragedy.
The Bench comprised Dr. Justice A.K. Jayasankaran Nambiar and Justice Preeta A.K. It instructed the State to bear all hospitalization expenses without placing any financial burden on the victims.
Court Acts After Fatal Tunnel Project Landslide
The Court intervened after a landslide struck the Anakkompoyil-Meppadi tunnel construction site on July 7, 2026. The tunnel project aims to improve road connectivity between Wayanad and Kozhikode.
During the hearing, the State submitted a status report. Government officials informed the Bench that six people had lost their lives in the incident.
Bench Orders Quick Return of Bodies to Families
The judges asked officials about the recovery process and whether authorities had returned the bodies to the victims’ families.
The Member Secretary of the Kerala State Disaster Management Authority (KSDMA) informed the Court that officials were coordinating with Sub-Divisional Magistrate Authorities. Several family members had already reached the site. Authorities were conducting post-mortem examinations, completing embalming procedures, and arranging transportation for the bodies.
The Bench stressed the need for urgency and observed:
“See that the bodies are repatriated to the relatives, they have other rituals to be done. There should not be any delay in hand over.”
Court Orders Free Treatment for Injured Victims
The Bench also reviewed the medical care provided to injured survivors. The KSDMA informed the Court that hospitals were treating the injured and that the government had already approved initial ex-gratia assistance.
The Court directed hospitals not to demand deposits or treatment charges from victims before discharge. It also instructed the State to provide proper accommodation and support for attendants and family members staying with injured patients.
State to Pay Now, Project May Bear Cost Later
The High Court directed the State to immediately pay for medical treatment and compensation. However, it clarified that these expenses would be recorded as costs linked to the tunnel project.
The Bench said it would later decide whether the project developers or contractors should reimburse the State for these payments.
