A trial court in Kerala has sentenced a woman to life imprisonment after convicting her for the murder of her one-year-old son, whom she threw into the sea. The court held that the offence squarely attracted the charge of murder under Section 302 of the Indian Penal Code.

The court ruled that the act was deliberate, cruel, and reflected complete disregard for the life of a defenceless child.

Facts Leading To The Conviction

According to the prosecution, the accused took her infant son to the seashore and intentionally threw him into the sea, resulting in his death. Local authorities later recovered the child’s body, and the police registered a case of murder after preliminary investigation.

The prosecution relied on circumstantial evidence, witness testimonies, and medical findings to establish the sequence of events and the culpability of the accused.

Court Finds Clear Intent And Criminal Liability

While delivering the sentence, the court observed that the evidence conclusively proved the accused’s intention to cause death. It rejected the defence argument seeking dilution of charges on grounds of emotional distress or momentary lapse.

The court emphasised that the age and vulnerability of the victim aggravated the offence and ruled out any possibility of treating the act as culpable homicide not amounting to murder.

The court held that no mitigating factors existed to justify a lesser sentence. It noted that the crime involved a complete breach of maternal responsibility and inflicted irreversible harm.

Observing that the offence shocked the collective conscience of society, the court ruled that life imprisonment was the appropriate punishment.

The court reiterated that crimes against children demand strict judicial response. It stressed that the justice system must send a clear deterrent message in cases involving extreme violence against minors.
