Apex Court Reaffirms Core Principles of Hindu Undivided Family Property Law

The Supreme Court of India has reaffirmed a foundational rule of Hindu law. It held that property acquired by the Karta of a Hindu Undivided Family (HUF) is presumed to be joint family property.

The Court clarified that this presumption stands unless the claimant clearly proves self-acquisition. As a result, the burden of proof rests squarely on the Karta asserting exclusive ownership.

Law Presumes Property Acquired by Karta Is Joint Family Property

The Supreme Court observed that when an HUF exists, the law raises a strong presumption in favour of joint ownership. If the Karta acquires property during the family’s subsistence, courts assume it benefits the joint family.

This presumption flows from the fiduciary role of the Karta. He manages family affairs for collective benefit, not for personal gain.

Karta Must Prove Self-Acquisition With Clear Evidence

The Bench rejected claims of absolute ownership unsupported by evidence. It held that the Karta must prove self-acquisition through clear and convincing material.

Importantly, the Court ruled that mere assertions, self-serving documents, or lack of contribution by other members cannot rebut the presumption.

Source of Funds Is the Decisive Test

The Supreme Court emphasised that the source of funds decides the nature of the property. If joint family income, ancestral assets, or a common nucleus supported the purchase, the property remains joint.

Only proof of acquisition from independent earnings, without any family aid, can establish self-acquired status.

Impact on Partition and Succession Disputes

Legal experts say the ruling will influence partition suits and succession disputes across courts. It curbs unilateral claims by Kartas and strengthens coparceners’ rights.

The judgment also offers clarity to trial courts handling complex family property disputes.

Clear Message on Protecting Joint Family Rights

By reaffirming the presumption of joint ownership, the Supreme Court sent a clear signal. Joint family rights cannot be diluted through unsupported claims of individual ownership.

The ruling preserves the balance between authority and accountability under Hindu law.
