The Madras High Court has granted an interim injunction in the Elite Matrimony Trademark Dispute involving Matrimony.com Limited and Bharathi, who operates Kongu Elite Matrimony. The Court found the mark “KONGU ELITE MATRIMONY” deceptively similar to the registered “ELITE MATRIMONY” mark.

Justice K. Kumaresh Babu held that Matrimony.com Limited had established its rights in the registered “ELITE MATRIMONY” trademark.
The Court found that the defendant’s service used the name “KONGU ELITE MATRIMONY”. It also found strong visual and phonetic similarities between the two marks.
Matrimony.com Limited provides online matchmaking services. The company alleged that the defendant’s mark infringed its trademark and amounted to passing off.
Matrimony.com’s Claims
Matrimony.com Limited approached the Madras High Court against Bharathi.
The company alleged that the use of “KONGU ELITE MATRIMONY” infringed its registered “ELITE MATRIMONY” trademark.
The word “Kongu” refers to the Kongu Nadu region of western Tamil Nadu. The defendant appeared to target customers from that region.
However, the defendant retained the words “ELITE MATRIMONY” in its trade name. Matrimony.com argued that this created a strong likelihood of confusion.
Three Applications Before The Court
Matrimony.com Limited filed three original applications.
The first application sought to stop the defendant from using “KONGU ELITE MATRIMONY” and related logos.
The second application challenged the use of the mark through domain names, mobile applications, and social media platforms.
The third application sought to prevent any transfer or change in ownership of the domain name “konguelitematrimony.co.in”.
Together, the applications sought protection across the defendant’s major digital and commercial platforms.
High Court’s Findings
The Court held that Matrimony.com’s registered “ELITE MATRIMONY” mark deserved legal protection.
The Court also found the defendant’s mark deceptively similar. Therefore, it granted the injunction sought by the applicant.
The Court applied the established principle of deceptive similarity under trademark law. A geographic or descriptive prefix does not always remove the likelihood of confusion.
In this case, the defendant added the regional word “Kongu” before “ELITE MATRIMONY”. The Court found that the core and memorable part of the registered mark remained the same.
The Elite Matrimony Trademark Dispute also highlights the importance of trademark protection in the digital matchmaking industry.
Consumers increasingly find matrimonial services through search engines, mobile applications, and social media. Therefore, similar names across these platforms can create significant confusion.
Relief Granted
The Madras High Court granted ad interim injunctions in all three applications.
The Court restrained the defendant, its agents, licensees, and representatives from using “KONGU ELITE MATRIMONY” or any deceptively similar mark.
The restriction covers trade names, domain names, mobile applications, and social media handles.
The Court also barred any transfer or change in ownership of “konguelitematrimony.co.in” until the suit reaches a final decision.
As a result, the order prevents the defendant from using the disputed mark across its key digital channels while the case continues.
