Delhi Riots Case: Court Summons Police Officers Over Custodial Death Linked to National Anthem Incident

Date:

Court Takes Cognisance of Alleged Police Excesses During 2020 Delhi Riots

A Delhi court has summoned several police personnel in connection with the death of a man allegedly forced to sing the National Anthem during the 2020 Delhi riots.

The court noted that, if proved, the allegations raise serious concerns about custodial violence and abuse of authority by law enforcement officials. The case stems from a widely reported incident during the riots, where injured men were allegedly assaulted and compelled to sing the National Anthem while lying on a public road.

Death Allegedly Followed Police Assault, Court Observes

The prosecution stated that the victim later succumbed to injuries allegedly suffered during the incident. The complainant claimed that police officials failed to provide medical assistance to the injured men.

The complaint further alleged that the police subjected the victims to physical and mental cruelty. After examining the material on record, the court found a prima facie case to proceed against the accused police officials.

Police Accountability Comes Under Judicial Scrutiny

The court emphasised that police officers have a constitutional duty to protect life and human dignity, even during public disorder. It observed that claims of maintaining law and order cannot justify acts that cross constitutional and statutory limits.

The court made it clear that uniformed authority does not confer immunity from criminal prosecution when allegations disclose serious offences.

National Anthem Incident Triggered Public Outrage

The incident triggered nationwide outrage after videos surfaced on social media. The videos showed injured men being forced to sing the National Anthem.

Civil rights groups and legal experts demanded accountability and stressed that patriotism cannot be enforced through coercion or violence. The present proceedings revive those concerns and place renewed focus on police conduct during the Delhi riots.

Legal Significance of the Summoning Order

Legal observers describe the summoning of police officials as a significant step towards reinforcing the rule of law. The order reiterates that courts will closely scrutinise allegations of custodial violence and misuse of power.

The case may have broader implications for policing standards, crowd control practices, and accountability mechanisms during communal violence.

What Lies Ahead

The court has directed the accused police officers to appear on the next date of hearing. The trial court will decide whether to frame charges after evaluating the evidence placed by the prosecution.
