Delhi High Court Grants Interim Trademark Protection to Barbie in India

In a significant decision for brand-owners, the Delhi High Court has extended interim protection to the trademark “Barbie” owned by Mattel Inc. (through its India subsidiary) in the case of Mattel Inc. v. Padum Borah & Ors. The court found that the defendant’s proposed mark “BARBIE one stop solution for HORECA & food processing” contained the dominant prefix “Barbie” and thus risked creating initial interest confusion in consumers. 

The dispute arose when the defendant, engaged in commercial kitchen equipment, event management and catering services, applied in August 2024 to register the mark “Barbie …” for its business activities. The Trade Marks Registry raised objections in March 2025, pointing out a conflict with Mattel’s established “Barbie” mark. The defendant responded by acknowledging Mattel’s well-known brand name but argued that its full combination was sufficiently distinctive. 

The court agreed with Mattel’s contention that the word “Barbie”, used as a large portion of the defendant’s mark, was likely adopted to leverage the goodwill of Mattel’s globally recognised brand. As a result, the court granted an interim injunction restraining the defendant from using the impugned mark in any manner, and ordered removal of domains and materials carrying the mark. The matter is scheduled for further hearing on 10 March 2026.This decision reinforces the legal principle known as the initial interest confusion test — which holds that confusion can arise at the outset of a consumer’s interest, even if eventual clarification occurs.The ruling highlights the continued importance of protecting well-known marks in India and the risks of adopting closely similar trade names in adjacent business fields.
