Delhi High Court Takes Firm Stand Against Parental Sexual Abuse

The Delhi High Court has firmly held that courts cannot show leniency to a father who raped his minor daughter. Upholding the conviction under the Protection of Children from Sexual Offences (POCSO) Act, the Court ruled that such crimes demand the strictest judicial response.

The Court stated that a father’s role as a protector makes the offence far more serious. Therefore, any plea for sympathy stands completely rejected.

Court Rejects Plea for Reduced Sentence

The accused sought a lighter sentence by citing personal circumstances. However, the High Court refused to entertain the request. It ruled that parental authority aggravates the crime instead of mitigating it.

Moreover, the Court observed that sexual violence by a parent causes deeper emotional and psychological harm. Consequently, the law must respond with severity and certainty.

Intra-Familial Abuse Requires Zero Tolerance

Importantly, the High Court emphasised that intra-familial sexual abuse often remains hidden. Fear, dependency, and shame prevent victims from reporting such crimes. Therefore, courts must adopt a victim-centric and deterrent approach.

The Bench clarified that the POCSO Act applies with equal force to family members. Hence, offenders cannot escape liability merely because of blood relations.

Child’s Testimony Can Sustain Conviction

The High Court upheld the trial court’s findings based on strong evidence. This included medical records and the consistent testimony of the child victim.

Notably, the Court reiterated that a child’s sole testimony can sustain conviction under POCSO, provided it inspires confidence. Minor inconsistencies, the Court added, do not weaken the prosecution’s case.

Crime Violates Trust, Dignity, and Childhood

The Court underlined that rape by a father destroys a child’s sense of safety and dignity. Such acts also shatter the moral foundation of the family unit.

Therefore, the judiciary must send a clear message. Crimes against children, especially by parents, will attract maximum punishment under law.

Conclusion

By upholding the conviction, the Delhi High Court reaffirmed its zero-tolerance policy toward child sexual abuse. The judgment makes it clear that parenthood cannot shield offenders from punishment.
