The Delhi High Court has issued a sweeping injunction restraining four online bookstores from selling counterfeit versions of S Chand and Company Limited’s textbooks, after finding that pirated editions were being marketed through their storefronts on Flipkart. The Court also directed Flipkart to immediately remove all infringing listings.
Justice Manmeet Pritam Singh Arora passed the ex parte ad-interim injunction on December 8, 2025, which will remain operational until May 6, 2026.
S Chand, a leading publishing house established in 1970, told the Court that it produces school, higher education and competitive exam books and holds several trademark registrations for its “S Chand” brand. It also owns copyright in numerous literary and artistic works, including book covers and illustrations.
The company discovered between March and April 2025 that four sellers—All Book Point, Fly Case Gallery, Arun Books, and Simra Collection—were offering counterfeit books under its name on Flipkart. After purchasing sample copies from two sellers in August 2025, S Chand’s printers confirmed that the books were pirated. The publisher also stated that despite submitting a complaint in April 2025, Flipkart failed to remove the listings.
After reviewing the evidence, the Court held that an ordinary consumer on Flipkart would be unable to distinguish the pirated books from genuine S Chand editions and would likely believe the sellers to be authorised distributors. The Court noted that none of the bookstores appeared before it and that the addresses listed in their GST records were fictitious.
“In these facts, it prima facie appears that Defendant Nos. 1 to 4 are indeed selling counterfeit books with the intent to ride upon the goodwill and reputation garnered by the Plaintiff in order to benefit commercially,” the Court observed.
Finding a strong case for interim protection, the Court barred the four sellers from printing, reproducing, selling or distributing counterfeit S Chand books and from using its registered marks in any manner. Flipkart has been directed to take down the infringing listings and respond within 72 hours to any future complaints by S Chand regarding pirated books sold by unidentified sellers.
The matter will be heard next on May 6, 2026.
