The Delhi High Court has directed the All India Institute of Medical Sciences (AIIMS) to constitute a Medical Board to independently assess the health condition of Jaideep Singh Sengar, brother of former Uttar Pradesh legislator and Unnao rape case convict Kuldeep Sengar.
A Division Bench of Justice Navin Chawla and Justice Ravinder Dudeja passed the direction while hearing Sengar’s plea seeking interim suspension of sentence on medical grounds in the custodial death case of the rape survivor’s father.
Sengar Claims Stage-IV Cancer, CBI Disputes Medical Records
Sengar claimed that he suffers from multiple serious and life-threatening ailments. These include alleged Stage-IV oral cancer with suspected recurrence, osteoradionecrosis, trismus, and chronic jaw infection.
He relied on medical prescriptions and treatment records to argue that his condition warranted interim relief.
The Central Bureau of Investigation (CBI) opposed the plea. It alleged that several medical prescriptions submitted by Sengar were fabricated. The agency submitted that while earlier treatment records appeared genuine, no reliable material established that Sengar currently suffers from Stage-IV cancer.
Court Orders AIIMS Medical Board Examination
After hearing both sides, the Court held that an independent expert evaluation was necessary. The Bench therefore directed the Director of AIIMS to constitute a Medical Board for a comprehensive medical examination.
Issues Referred to the Medical Board
The Medical Board has been asked to examine and report on:
- Whether Sengar is suffering from cancer or any other life-threatening disease, and the stage of such illness, if any
- Whether the required treatment can be provided in the jail hospital or through escorted treatment at government hospitals
Directions to Jail Authorities and Listing Date
The Court directed the Jail Superintendent to produce Sengar before the Medical Board. It also ordered that all available medical records be placed before the Board.
The Court permitted Sengar to submit his prior medical history for the Board’s consideration.
The matter has been listed for further hearing on March 2.
Background of the Case
The Court noted that Sengar had earlier secured interim bail on July 3, 2024, for two months on medical grounds.
In the custodial death case of the rape survivor’s father, Kuldeep Sengar and Jaideep Sengar were sentenced on March 13, 2020, to ten years’ rigorous imprisonment and a fine of ₹10 lakh.
