Supreme Court Approves Environment Compensation Charge Hike For Commercial Vehicles Entering Delhi, Orders 5% Annual Increase

In the MC Mehta pollution matter, the Supreme Court approved revised Environment Compensation Charges for commercial vehicles entering Delhi and directed a uniform 5% annual escalation to curb air pollution.

The Supreme Court, in the ongoing M.C. Mehta v. Union of India matter concerning air pollution in Delhi, approved the enhancement of Environment Compensation Charges levied on commercial vehicles entering the National Capital Territory of Delhi.

A Bench comprising Justice Abhay S. Oka and Justice Ujjal Bhuyan, by order dated April 16, 2026, accepted the recommendations placed before it and directed that the ECC rates shall be subject to a 5% annual increase.

The matter arises from long-standing proceedings in M.C. Mehta v. Union of India, wherein the Supreme Court has been issuing continuing directions to combat air pollution in Delhi and the NCR region.

Environment Compensation Charges were earlier introduced as a regulatory measure to discourage the entry of polluting commercial vehicles into Delhi and to offset environmental damage. Over time, concerns were raised regarding the adequacy of the existing Environment Compensation Charge rates in light of rising pollution levels.

During the proceedings, recommendations were placed before the Court for revising the Environment Compensation Charge structure applicable to different categories of commercial vehicles entering Delhi.

It was submitted that the existing rates required rationalisation and periodic enhancement to remain effective as a deterrent against vehicular pollution. The proposal also included a mechanism for automatic annual escalation to ensure that the charges do not become obsolete over time.

Court’s Observations: Need For Dynamic Pollution Control Measures

The Court noted that the Environment Compensation Charge is an important regulatory tool aimed at reducing vehicular emissions and compensating for environmental degradation caused by commercial traffic entering Delhi.

It observed that periodic revision of such charges is necessary to maintain their deterrent effect and to align with evolving environmental concerns. The Bench emphasised that environmental protection requires continuous and adaptive measures rather than static regulatory frameworks.

Accepting the recommendations, the Supreme Court:

  • Approved the revised rates of Environment Compensation Charges for commercial vehicles entering Delhi
  • Directed that the Environment Compensation Charge shall be increased by 5% annually
  • Ordered implementation of the revised framework in accordance with the recommendations placed before it

The matter continues to remain under the Court’s monitoring in the larger public interest litigation concerning air pollution control.
