Court notes lack of direct evidence and prolonged custody; holds trial likely to take time
A Delhi court has granted bail to I-PAC Director Vinesh Chandel in a money laundering case. The Court observed that the record did not show any direct evidence linking him to the alleged proceeds of crime.
The Court also noted that his continued custody was not necessary at this stage.
Case Arose From Money Laundering Allegations
The case arose from allegations of financial irregularities and money laundering. The prosecution accused Chandel of involvement in handling alleged proceeds of crime.
The Enforcement Directorate registered the case under the Prevention of Money Laundering Act, 2002. During the investigation, ED arrested Chandel.
Chandel Sought Bail Before Delhi Court
Chandel moved the Delhi court seeking bail. The Court examined the prosecution material and heard the submissions made by both sides.
Counsel for Chandel argued that the record did not show his direct role in the alleged offence. He also submitted that further custody would be unjustified.
ED Opposed Bail Plea
The prosecution opposed the bail application. It argued that the investigation was still pending.
ED also claimed that Chandel had a role in the alleged financial transactions.
Court Finds No Direct Link To Proceeds Of Crime
The Court observed that the material on record did not disclose any direct evidence against Chandel. It found no direct link between him and the generation or laundering of alleged proceeds of crime.
The Court also considered the period of custody already undergone by the accused.
Trial Likely To Take Time
The Court noted that the trial may take considerable time to conclude. Therefore, it held that keeping Chandel in custody would not serve any useful purpose at this stage.
The Court also found that the requirements for granting bail under the PMLA stood satisfied in the facts of the case.
Court Orders Release On Bail
Allowing the bail application, the Court directed that Vinesh Chandel be released on bail.
It imposed conditions to ensure his cooperation with the investigation and his presence during trial proceedings.
