‘Cash for Query’ Allegations: Delhi High Court Grants Lokpal Two Months to Decide Sanction Against Mahua Moitra

Date:

High Court Fixes Timeline in High-Profile Ethics and Corruption Row

The Delhi High Court has granted two months’ time to the Lokpal of India to take a final decision on the issue of sanction in connection with the alleged “cash for query” allegations involving Mahua Moitra.

The Court passed the direction while hearing a plea seeking expeditious adjudication of the sanction question, which remains pending before the Lokpal.

Court Emphasises Timely Decision by Statutory Authority

The Delhi High Court observed that prolonged pendency of the sanction issue defeats the very purpose of statutory oversight mechanisms. Accordingly, the Court fixed a specific time frame and directed the Lokpal to take an appropriate decision in accordance with law within two months.

The Court clarified that it has not expressed any opinion on the merits of the allegations, and its intervention is limited to ensuring procedural discipline and timely action.

Background of the ‘Cash for Query’ Allegations

The controversy relates to allegations that Mahua Moitra, while serving as a Member of Parliament, accepted monetary and other benefits in exchange for raising questions in Parliament. Complaints were filed before the Lokpal alleging abuse of office and ethical misconduct.

The matter has drawn significant public attention due to its implications for parliamentary integrity, probity in public life, and accountability of elected representatives.

Sanction Requirement Central to Further Proceedings

The issue before the Lokpal concerns whether sanction is required to proceed further under the applicable legal framework. Until such a decision is taken, no substantive action can move forward.

The High Court noted that uncertainty over sanction:

  • Stalls further legal proceedings
  • Creates avoidable ambiguity
  • Undermines confidence in institutional processes

Therefore, the Court held that the Lokpal must reach a reasoned decision within a defined period.

Judicial Restraint and Institutional Balance

While issuing directions, the Delhi High Court reiterated that courts must respect the autonomy of constitutional and statutory bodies. However, judicial oversight becomes necessary when delays threaten procedural fairness or statutory intent.

By fixing a deadline, the Court sought to balance institutional independence with administrative accountability.

Legal Significance of the Order

This order underscores:

  • The duty of oversight bodies to act within reasonable timelines
  • Judicial insistence on procedural certainty in corruption-related matters
  • The importance of sanction decisions in public office investigations

The matter is expected to progress further once the Lokpal communicates its decision within the stipulated period.
