Bombay HC: Single Mother Is Complete Parent, Orders School Record Correction

The Bombay High Court at Aurangabad directed authorities to modify a minor girl’s school records. The Court ordered deletion of the father’s name and substitution with the mother’s name and surname. It also allowed correction of the child’s caste entry from “Maratha” to “Mahar,” reflecting the mother’s Scheduled Caste status.

A Division Bench of Justice Vibha Kankanwadi and Justice Hiten Venegavkar delivered the judgment on February 2 in XYZ v. State of Maharashtra.

Constitutional Recognition of Single Mother

The Bench held that recognising a single mother as a complete parent is not charity. It is constitutional fidelity.

The Court said the Constitution moves society from patriarchal compulsion to constitutional choice. It shifts identity from lineage to dignity.

The judges stated that a developing society cannot tie a child’s public identity to a father absent from her life. When the mother bears full responsibility, the State cannot treat her as secondary.

Administrative formats must reflect welfare realities. They must not enforce outdated social assumptions.

Identity, Dignity and Equality

Referring to Article 21, the Court said the right to life includes the right to dignity. Dignity includes the right to an identity not forcibly linked to an absent parent.

School records are public documents. They follow a child for years. A child raised only by her mother cannot be forced to carry the father’s name because older formats required it.

Invoking Article 14, the Bench held that identity flowing automatically through the father reflects patriarchal structure. It is not neutral administration.

Making the father’s name indispensable while treating the mother’s as optional reproduces inequality. The Constitution does not permit such asymmetry.

The Bench also relied on Articles 39(f) and 46. Educational records must not become instruments of stigma. The State must evolve.

Caste Correction Allowed

The State argued that caste entries cannot change casually and that schools cannot adjudicate caste. The Court agreed in principle.

However, it rejected a rigid default rule. The child lives solely with her Scheduled Caste mother. She has no relationship with the father.

The Bench recognised concerns about misuse of caste certificates. It also preserved the statutory verification process.

The Court clarified that this correction does not amount to voluntary caste alteration. It corrects the record to reflect the true social and legal position.

The welfare and best interest of the child remain paramount.

Facts of the Case

The petition was filed jointly by a 12-year-old girl and her mother. They sought deletion of the father’s name and caste from the birth certificate and school records. They asked that the mother’s name, surname, and caste be substituted.

The mother is a rape survivor. DNA testing confirmed the accused as the biological father. Later, the mother and the accused executed an agreement. The father declared he would have no role or responsibility in the child’s life. The mother undertook sole guardianship.

Despite this, routine administrative entries reflected the father’s details. When the mother sought correction, school authorities refused. She then approached the High Court.

The Bench recorded that the child has grown up entirely within the Mahar Scheduled Caste community of her mother. She has no social or familial ties with the Maratha community of the father.

Referring to Articles 14, 15, and 21, the Court said constitutional adjudication must examine lived reality. When subordinate codes deny relief that affects dignity and future, constitutional courts must intervene.

The Court directed the authorities to modify the school records accordingly.

The matter was titled XYZ v. State of Maharashtra.
