Allahabad High Court Grants Bail to YouTuber Mani Meraj After Couple Agrees to Marry Under Special Marriage Act

Date:

The Allahabad High Court on Tuesday granted bail to YouTuber and comedian Mani Miraj, also known as Ramdi Miraj Alam. He faces allegations including rape, assault, unnatural offences, and forced abortion.

A Bench of Justice Gautam Chowdhary passed the order after the informant/victim appeared in person and submitted a handwritten statement. She told the Court that the parties had reached a mutual compromise.

What the Victim Told the Court

In her statement, the informant said the accused had secretly married her earlier. She claimed he later refused to marry her publicly.

She also informed the Court that both sides have now agreed to marry within 1–2 weeks under the Special Marriage Act.

Bail Linked to Marriage Timeline

The Court granted bail but added an important condition.

It gave the informant liberty to seek cancellation of bail if the accused, after release, does not marry her under the Special Marriage Act within two weeks. The Court specifically recorded that she may file a bail cancellation application if he fails to do so within the stipulated period.

Allegations in the Case

As per the case record, the informant earlier stated—during her statements recorded under Sections 180 and 183 of the BNSS—that:

  • she became acquainted with the applicant during work,
  • he allegedly committed forced rape,
  • he promised marriage through court marriage, and
  • he allegedly caused an abortion.

The applicant was arrested in October last year.

What the Lawyers Argued

Applicant’s Side

Counsel for the applicant told the Court that his client would marry the victim within two weeks of being released on bail. The counsel also said the applicant’s family members support the relationship.

Victim’s Side

Counsel for the victim stated that they had no objection to bail.

State’s Side

The Additional Government Advocate opposed bail. The State argued that the alleged offences are serious and cognizable, so the Court should not grant bail.

Court’s Reasoning and Order

After hearing all sides, the Court noted:

  • the nature of the evidence,
  • the lack of any solid contradictory material placed before it, and
  • that tampering with the available material appeared unlikely.

Based on this, Justice Chowdhary held that a case for bail was made out.

The Court directed release on bail upon furnishing a personal bond and two local sureties.
