Saket Court seeks response in revision plea challenging refusal to register FIR over remarks on Varanasi arrests


A Delhi court has issued notice on a plea seeking registration of an FIR against Mahua Moitra over her tweet concerning the arrest of individuals linked to a Ganga Iftar gathering in Varanasi.

The matter arises from the arrest of 14 Muslim men accused of organising an Iftar gathering on a boat in the Ganga river in Varanasi and allegedly throwing food waste into the river.

Following these arrests, Moitra had posted a tweet criticising the police action, which subsequently became the subject of legal challenge. 

A complaint was initially filed seeking registration of an FIR against her, but the magistrate court declined to pass such directions.

The revision plea challenging the magistrate’s order was filed by a law student, Ram Pravesh Dubey.

The matter was heard by Additional Sessions Judge Sonu Agnihotri at the Saket Courts, who issued notice to Moitra on the revision petition.

The Court directed issuance of notice to the respondent and listed the matter for further hearing. 

The plea seeks registration of an FIR under provisions of the Bharatiya Nyaya Sanhita, including offences relating to promoting enmity, acts prejudicial to national integration, outraging religious feelings, and spreading rumours.

It challenges the refusal of the magistrate court to direct investigation into the tweet. 

The Delhi court has not expressed any opinion on the merits of the allegations at this stage and has issued notice to seek Moitra’s response.

The matter is now pending adjudication before the Saket court, which will examine the validity of the challenge to the magistrate’s order.
