Delhi High Court Rejects Mechanical Denial of Disability Pension

The Delhi High Court has ruled that authorities cannot deny disability pension to Air Force personnel merely by branding hypertension as a lifestyle disorder.

The Court held that pension authorities must examine each case on its own facts. A blanket classification, the Court said, violates principles of fairness and service jurisprudence.

Court Emphasises Case-Specific Medical Assessment

The petitioner, an Air Force personnel, challenged the denial of disability pension. Authorities rejected his claim by calling hypertension a lifestyle-related condition.

However, the High Court rejected this reasoning. It observed that medical boards must assess whether service conditions aggravated the disease.

Therefore, authorities must determine the causal connection between service stress and hypertension.

Hypertension Cannot Be Treated as Non-Service Related by Default

The Court clarified that hypertension may develop due to service-related stress, operational duties, or harsh conditions.

Consequently, pension authorities cannot assume that lifestyle alone caused the illness. Such assumptions, the Court noted, undermine the rights of serving personnel.

The judgment stressed that reasoned medical opinions must support pension decisions.

Disability Pension Denial Requires Proper Justification

Importantly, the High Court ruled that denial of disability pension requires clear justification. Authorities must rely on medical evidence, not general labels.

Moreover, the Court held that mechanical rejection defeats the beneficial object of pension laws. Service personnel, the Court said, deserve fair consideration.

Relief Granted and Matter Remanded

Accordingly, the High Court set aside the impugned order denying disability pension. It directed authorities to reconsider the claim after proper medical evaluation.

The Court instructed officials to pass a reasoned order within a fixed timeline.

Conclusion

The Delhi High Court’s ruling strengthens protections for armed forces personnel. It confirms that hypertension cannot automatically disqualify disability pension claims.

The judgment reinforces that service-related diseases require individual assessment, fairness, and medical reasoning.
