The Family Court must assess the financial circumstances of both spouses. It must also consider other relevant factors before deciding the appropriate amount.
Justice Banerjee called for an assessment based on the cumulative circumstances of the parties.
Wife’s Qualifications and Earning Capacity Matter
The Court specifically highlighted the wife’s educational qualifications and earning capacity.
However, the judgment does not mean that an educated or professionally qualified wife automatically loses her right to maintenance.
Instead, the court must examine whether her qualifications affect her ability to earn. It must consider her actual circumstances along with other relevant financial factors.
The Court therefore rejected an approach that looks only at the husband’s income.

The High Court observed that courts cannot apply a fixed formula based exclusively on the husband’s earnings.
Instead, they must consider the overall financial circumstances of both parties.

- Other circumstances affecting their ability to support themselves
