Employee Who Accepts Post-Resignation Financial Benefits Barred From Retracting Resignation or Challenging Its Validity: Supreme Court

The Supreme Court of India ruled that the principle of Resignation Benefits Estoppel prevents an employee from challenging a resignation after accepting terminal benefits. The Court held that once an employee voluntarily receives settlement payments linked to the end of service, they cannot later withdraw the resignation or dispute its validity.

Supreme Court Applies Acquiescence and Estoppel

A Division Bench heard a service dispute involving an employee who accepted financial benefits after resignation. The Court observed that accepting terminal dues shows clear acceptance of the employer’s decision. Therefore, an employee cannot retain those benefits while simultaneously questioning the resignation process.

Financial Benefits End the Right to Withdraw Resignation

The Supreme Court explained that an employee may withdraw a resignation before the competent authority formally accepts it. However, that right ends once the resignation takes effect and the employee accepts financial benefits such as gratuity, provident fund, severance compensation, or other settlement amounts.

The Bench stated that accepting these benefits creates a binding estoppel. Allowing employees to challenge an accepted resignation after receiving full and final settlement would create uncertainty in service administration and weaken established employment law principles.

Courts Must Examine Employee Conduct

The Supreme Court directed trial courts, labour tribunals, and High Courts to determine whether an employee accepted terminal benefits without protest before challenging a resignation.

The Court concluded that when an employee accepts financial entitlements arising from resignation, the employer-employee relationship ends. As a result, the principle of Resignation Benefits Estoppel bars claims for reinstatement, back wages, or declarations of continued service.
