Delhi High Court Lists Arvind Kejriwal’s Challenge In CBI Case Before Justice Manoj Jain Following Recusal

Date:

The Delhi High Court reassigned Arvind Kejriwal’s plea concerning the CBI proceedings in the excise policy case to Justice Manoj Jain after Justice Swarana Kanta Sharma recused from hearing the matter.

The Delhi High Court has listed Chief Minister Arvind Kejriwal’s plea against the Central Bureau of Investigation (CBI) proceedings in the Delhi excise policy case before Justice Manoj Jain. The listing came after Justice Swarana Kanta Sharma recused from hearing the matter.

The High Court reassigned the case under its roster and administrative procedure. The matter will now proceed before Justice Manoj Jain.

Background of the Case

The case relates to the CBI investigation into the Delhi excise policy matter. Arvind Kejriwal moved the Delhi High Court to challenge the criminal proceedings against him. He also raised issues concerning discharge and continuation of the case.

The litigation forms part of a larger group of cases linked to the excise policy investigation. Several courts are hearing matters connected to investigations by central agencies.

Justice Swarana Kanta Sharma Recuses

The matter first came before Justice Swarana Kanta Sharma. During the hearing, Justice Sharma recused from the case.

After the recusal, the High Court transferred the matter to another Bench under the roster system. The Court did not examine the merits of the case at this stage.

Administrative Reassignment

Following the recusal, the Delhi High Court registry listed the matter before Justice Manoj Jain for further hearing.

Courts routinely reassign cases after a judge recuses. The transfer only ensures continuity in proceedings. It does not reflect any opinion on the merits of the dispute.

Delhi Excise Policy Investigation

The proceedings arise from the wider Delhi excise policy investigation. The CBI has alleged irregularities in the policy’s formulation and implementation.

Arvind Kejriwal has challenged the continuation of proceedings against him before the Delhi High Court. The present plea focuses on discharge and the legality of further criminal proceedings in the CBI case.

Merits Yet to Be Heard

The Delhi High Court has not yet examined the merits of Kejriwal’s challenge. The recent development concerns only the procedural transfer of the case after the earlier Bench recused.

Justice Manoj Jain will now hear the substantive issues raised in the petition.

Matter to Continue Before New Bench

The case will continue before Justice Manoj Jain in line with the High Court’s schedule and roster directions.

The present development marks another procedural step in the ongoing litigation related to the Delhi excise policy investigation and connected criminal proceedings.
