Court Directs Senior-Level Investigation in Alleged Public Humiliation Case

The Orissa High Court has directed that the investigation into an alleged incident involving the public stripping of a Muslim man and coercion to utter “Jay Sri Ram” be handed over to a senior police officer not below the rank of Deputy Superintendent of Police (DSP) or Sub-Divisional Police Officer (SDPO). 

The direction was issued by Justice Savitri Ratho while allowing a petition filed by the father of the victim.

The case arises from allegations that the victim was publicly stripped and forced to chant a religious slogan, leading to serious concerns regarding dignity, personal liberty, and communal targeting. 

Aggrieved by the manner in which the investigation was being conducted, the victim’s father approached the High Court seeking intervention and an effective probe into the incident.

Taking note of the allegations, the Court directed the Director General of Police (DGP) to ensure that the investigation is transferred to a senior-ranking officer. 

The Court specifically ordered that the probe be carried out under the supervision of an officer not below the rank of DSP/SDPO, indicating the need for a more robust and independent investigation.

The Court’s intervention underscores the requirement of:

  • Ensuring a fair and impartial investigation
  • Addressing allegations involving public humiliation and coercion
  • Maintaining accountability in cases with potential communal implications

The direction for senior-level supervision reflects judicial concern regarding the seriousness of the allegations and the adequacy of the initial investigation.

The matter stands disposed of with directions for supervised investigation, and further action will depend on the outcome of the probe conducted under the designated officer.
