Apex Court Balances Child Welfare With Legal Rights, Stability, and Surrounding Circumstances
The Supreme Court of India has clarified an important principle governing child custody disputes, holding that while the welfare of the child remains paramount, it cannot be treated as the sole or exclusive consideration in deciding custody and guardianship issues.
The ruling underscores that courts must adopt a holistic and balanced approach, weighing multiple relevant factors rather than relying on a single, abstract standard of welfare.
Welfare Is the Guiding Star, Not a Mechanical Formula
The Supreme Court observed that the concept of a child’s welfare is broad, dynamic, and context-specific, encompassing emotional well-being, moral upbringing, physical care, education, stability, and overall development.
