Court Reaffirms Zero Tolerance for Corruption in Public Service
Thirty years after the offence, the Delhi High Court has upheld the conviction of a police Assistant Sub-Inspector (ASI) for accepting a bribe of ₹5,000. Through this ruling, the Court reaffirmed the judiciary’s firm stance against corruption within law-enforcement agencies.
The Court dismissed the convict’s challenge to the trial court judgment. It clearly held that delay in adjudication cannot dilute the seriousness of a proven corruption offence under criminal law.
Background of the Bribery Case
The case arose from allegations that the police ASI demanded and accepted illegal gratification while discharging his official duties. Acting on the complaint, anti-corruption authorities conducted a trap operation. During the operation, officials caught the accused red-handed while receiving the bribe amount.
Thereafter, the trial court examined the evidence on record. Finding the prosecution case credible, the court convicted the officer under the Prevention of Corruption Act and imposed sentence accordingly.
High Court Finds Evidence Reliable and Conviction Lawful
While hearing the appeal, the High Court carefully scrutinised witness testimonies, recovery memos, and procedural compliance. Upon evaluation, the Court found that the prosecution successfully proved:
- Demand for illegal gratification
- Voluntary acceptance of the bribe
- Recovery of tainted money
- Compliance with statutory safeguards
Accordingly, the Court rejected the defence plea of false implication. It ruled that minor inconsistencies cannot override clear and substantive proof of corruption.
Delay Cannot Erase Criminal Liability
When the appellant argued that the incident had occurred nearly three decades ago, the High Court firmly rejected the contention. The Court clarified that mere passage of time does not extinguish criminal culpability, especially in cases involving abuse of public office.
Further, the Court observed that granting leniency solely on the ground of delay would send a wrong message. Such an approach, it noted, would weaken deterrence against corruption in public administration.
Judicial Message Against Police Corruption
Importantly, the Court underscored that police personnel hold positions of public trust. Therefore, they must maintain the highest standards of integrity. Any deviation, the Court held, strikes at the very foundation of the rule of law and erodes public confidence in the justice system.
By affirming the conviction, the High Court reiterated that law-enforcement officers are not above the law and must face strict consequences for misconduct.
