Senior Citizen Alleges Massive Financial Loss Through Sophisticated Cyber Scam
A senior citizen who allegedly lost ₹22.92 crore in a “digital arrest” cyber fraud has approached the Supreme Court of India. He seeks nationwide preventive guidelines, institutional accountability, and restitution of the defrauded amount.
According to the plea, this form of cyber fraud is rapidly increasing. It particularly targets elderly and vulnerable citizens. Fraudsters operate under the false guise of law-enforcement action.
What Is The ‘Digital Arrest’ Scam?
As stated in the petition, fraudsters impersonated officials from central investigating agencies and law-enforcement authorities. They falsely accused the petitioner of serious financial offences.
Thereafter, the scammers subjected him to continuous video calls, intimidation, and psychological pressure. As a result, the victim transferred large sums of money to so-called “secure” accounts.
The plea explains that the fraudsters created an illusion of lawful custody without any physical detention. This tactic effectively amounted to a “digital arrest” and impaired the victim’s ability to make rational decisions.
Plea Seeks Preventive Guidelines Against Cyber Coercion
The petitioner has sought binding directions to the Union Government, investigating agencies, banks, and telecom service providers. He has urged authorities to evolve a uniform preventive framework to combat digital arrest scams.
Specifically, the plea seeks:
- Public advisories clarifying that no arrest or verification can occur through video calls
- Faster freezing of suspicious accounts
- Stronger coordination between banks and enforcement agencies
- Improved safeguards for senior citizens against cyber intimidation
Restitution And Institutional Accountability Sought
In addition to preventive measures, the petitioner has prayed for restitution of the defrauded ₹22.92 crore.
He contends that systemic lapses by banks and regulatory authorities allowed the scam to continue unchecked. Moreover, delayed action in freezing accounts and tracing fund trails aggravated the loss. Therefore, the plea seeks compensatory relief and institutional accountability.
Case Highlights Vulnerability Of Senior Citizens
The petition underscores that senior citizens remain especially vulnerable to technology-driven coercion. Scammers often exploit fear of arrest, criminal liability, and reputational damage.
Accordingly, the petitioner has urged the Supreme Court to recognise digital arrest fraud as a distinct form of organised cybercrime requiring targeted legal and administrative responses.
Court Asked To Invoke Constitutional And Inherent Powers
Invoking Articles 21 and 142 of the Constitution, the petitioner has sought the Court’s intervention to:
- Protect the right to life, dignity, and financial security
- Issue pan-India preventive guidelines
- Ensure victim-centric remedies in large-scale cyber fraud cases
Significance Of The Case
If the Court entertains the plea, it could lead to authoritative guidelines on cyber fraud prevention. Similar judicial interventions have earlier addressed emerging technological threats.
Overall, the matter highlights the urgent need for robust legal safeguards against digital impersonation and coercive cyber tactics in an increasingly online financial ecosystem.
