Attendance Deficiency Cannot Curtail Examination Rights: Delhi High Court Grants Relief To DU Law Student

Date:

Court Rules Attendance Shortfall Alone Insufficient To Bar Student From Exams

The Delhi High Court has granted relief to a Delhi University law student, holding that mere shortage of attendance cannot automatically justify detention from examinations. The Court ruled that academic authorities must enforce attendance rules in a fair and reasonable manner.

The Bench clarified that rigid application of attendance norms, without examining individual facts, may result in unjust academic consequences.

Facts Leading To The Petition

The petitioner, a law student at Delhi University, challenged the decision of university authorities that barred the student from appearing in examinations due to attendance deficiency. The student submitted that personal and unavoidable circumstances caused the shortfall.

Moreover, the petitioner argued that denying examination access would cause irreversible academic loss and violate principles of fairness.

Court Emphasises Proportionality And Fairness

Allowing the plea, the High Court observed that attendance requirements aim to ensure discipline. However, authorities must not apply them mechanically or punitively.

The Court stressed that detention from examinations is a harsh measure. Therefore, universities must consider proportionality before imposing such consequences.

Directions To University Authorities

The Court directed the university to permit the student to appear in the examinations. It further held that academic discretion must align with natural justice and equity.

Additionally, the Bench observed that educational institutions must balance regulatory discipline with students’ legitimate academic expectations.

Significance Of The Judgment

This ruling reinforces that students’ examination rights cannot be denied solely on technical grounds. It also serves as guidance for universities to adopt a humane and balanced approach while enforcing attendance norms.

Consequently, the judgment is likely to influence future disputes relating to attendance rules, examination eligibility, and student rights in higher education.
